Costa Rica Gaming License

Introduction

TThere’s no real regulation in place in Costa Rica, to provide the legal framework for the provision of the Gaming Services. The government is still working towards a regulated environment.

Permitted Activities

    It’s illegal for residents to gamble online and to gamble at all on games that have any random outcome.

    However, according to Costa Rican law, the physical location of an online gambling operator’s server isn’t where gambling actually takes place. Therefore, companies can offer online gambling services from Costa Rica, provided they don’t offer them to residents of the region. Inorder to operate, a company needs a data processing license or an internet gaming license - which is not strictly required.

    Entity Requirements

    The entity making the application is a Costa Rican Company which Includes;
    a) A Corporation
    b) Limited liability companies

    Director’s Requirements

    The licensee will need at least 1 (one) natural person Fit and Proper Directors of any jurisdiction.

    Shareholder requirements

    • The investment dealer will need at least one shareholder.
    • Corporate shareholding is allowed and 100% foreign ownership is permitted.

    Legal Representative

    The Applicant must employ at least one legal representative residing in the Country or appoint a resident Agent.

    Local Office

    The company must have an office in Costa Rica and some employees must reside there.

    Auditor

    Having an Auditor is not a requirement

    Insurance

    It is not a requirement to have an indemnity insurance coverage or a fidelity bond.

    Minimum Capital Requirements

    No requirements for the minimum share capital

    Ongoing Obligations

    • An annual fee must be paid irrespective of whether it is a commercially active company or not.
    • No specific reporting and audit requirements
